Agreement to these terms

These terms apply when you use the SurveyX website at surveyx.co, install SurveyX Builder, or buy a SurveyX Pro licence. By doing any of those things you agree to them. If you do not agree, please do not use SurveyX. In these terms, "we" and "us" mean the team that publishes SurveyX, reachable at [email protected], and "you" means the person or organisation using it. Paid licences are sold by Freemius on our behalf, and their identification as merchant of record appears on your invoice and in the licence agreement for SurveyX Builder.

You must be old enough and legally able to enter into a contract in your country. If you are agreeing on behalf of a company or client, you confirm that you are authorised to do so, and these terms bind that organisation.

The free plugin

SurveyX Builder is published on WordPress.org and distributed under the GNU General Public License, version 2 or later. Under that licence you are free to use it on any number of sites, study it, modify it and redistribute it on the same terms. Nothing in these terms takes away a right the GPL grants you.

The free version comes with no service commitment. Support for it is community support, through the WordPress.org support forum, on a best-effort basis.

Your Pro licence

A Pro licence gives you a limited, non-exclusive, non-transferable and revocable right to install and use the Pro features, for as long as the licence is active, on up to the number of sites your plan covers. That is 1 site on Starter, 3 on Professional, and 10 or 100 on Business. Local and staging installs used to develop or test a covered site do not count towards that number.

While your licence is active it also includes plugin updates and priority support through our ticket system, on the terms set out in our Support Policy. You may use SurveyX on sites you build for clients, within your site allowance.

Your licence key identifies you to our update service. Please keep it to yourself. If you need more sites than your plan covers, upgrade the plan rather than reusing the key, since activations beyond your allowance may be suspended.

Ownership

SurveyX, including its source code, design, documentation, name and logo, belongs to us and is protected by copyright and other intellectual property laws. Buying a licence buys you the right to use the software as described above, not ownership of it. Open-source components bundled with SurveyX remain under their own licences.

Everything you create with SurveyX stays yours. We claim no rights over your surveys, your themes or your content.

The other product names we mention (WordPress, Freemius, Mailchimp, Elementor, Cloudflare Turnstile, Google reCAPTCHA and the rest) are trademarks of their respective owners. We name them only to say what SurveyX works with. Doing so is not a claim of affiliation, sponsorship or endorsement by any of them.

What you agree not to do

You are responsible for what you build with SurveyX and for the laws that apply to it. In particular, please do not:

• redistribute, resell or sublicense the Pro files or your licence key, or bundle them into another product;
• work around, disable or reverse-engineer the licensing and update system, or remove copyright and attribution notices from the code;
• collect personal data through a survey without a lawful basis, or without telling people what you are collecting and why;
• collect payment card numbers, health records, government identifiers or similar sensitive data through a survey form;
• run surveys that are unlawful, deceptive, or designed to harass, defraud or impersonate; or
• attempt to break into, overload or disrupt our website or update service.

Payment, renewal and cancellation

Pro licences are sold through Freemius, our payment provider and merchant of record, whether you check out from this website or from inside the plugin. The sale itself is therefore made with Freemius rather than with us, and the Freemius End User License Agreement for SurveyX Builder applies to that transaction alongside these terms. Prices are shown on the pricing page and exclude any taxes that apply in your country, which Freemius calculates and collects at checkout.

Annual plans renew automatically so that updates and support continue without a gap. You can cancel the renewal at any time from your Freemius account. Cancelling takes effect at the end of the term you have already paid for and stops future charges. Lifetime licences are a single payment and do not renew.

We may change our prices from time to time. Changes apply to new purchases and to renewals after reasonable notice, and never retroactively to a term you have already paid for.

Refunds and payment disputes

First-time Pro purchases are covered by a 14-day money-back guarantee: if you change your mind before downloading the Pro files, or if something is genuinely broken and we cannot fix it inside those 14 days, you get your money back. The conditions, exclusions and process are set out in our Refund Policy, which forms part of these terms.

That guarantee is what we offer on top of the law, not instead of it. Where mandatory consumer law in your country gives you a broader right, such as a statutory right of withdrawal for digital purchases, that right applies regardless of anything in this policy, and Freemius as merchant of record handles it.

If something looks wrong on your bill, please email us before contacting your bank. Almost every billing problem is faster to fix directly. A chargeback raised without contacting us first may result in the associated licence being suspended while the dispute is resolved.

Your surveys and your data

Everything you create with SurveyX, including every response your visitors submit, is stored in your own WordPress database on your own hosting. We have no access to it, and we cannot retrieve, restore or delete it for you.

Because the data lives with you, you are the data controller for the people who answer your surveys. Meeting your obligations to them, including notice, consent, retention and responding to their requests, is your responsibility. Our Privacy Policy explains the little information that reaches us.

Third-party services

SurveyX depends on services we do not control, including WordPress, Freemius, your hosting provider, and any integration you choose to enable such as Mailchimp or a CAPTCHA provider. Their own terms and privacy policies apply to your use of them, and we are not responsible for their availability, changes or failures.

Updates and changes to the product

We work to keep this website and our update service available, but we do not guarantee uninterrupted service. SurveyX develops over time, so features may be added, changed or retired, and we may end support for versions of WordPress and PHP that no longer receive security updates. Where a change materially reduces what an active paid licence provides, we will announce it on this website.

A lifetime licence covers updates and support for as long as we continue to sell and maintain SurveyX. "Lifetime" refers to the life of the product, not to the lifetime of the purchaser. If we ever discontinue SurveyX, the version you hold remains yours to use, but updates and support will end.

No warranty

SurveyX is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that SurveyX will be uninterrupted or error-free, that it will meet your requirements, or that it will be compatible with every theme, plugin, host or configuration.

Keeping working backups of your website and its database is your responsibility, and we strongly recommend taking one before any plugin update.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, nor for lost profits, lost revenue, lost or corrupted data, or business interruption, arising out of your use of or inability to use SurveyX, even if we have been advised that such loss is possible.

Where liability cannot be excluded, our total liability to you for all claims relating to SurveyX is limited to the amount you paid us in the twelve months before the claim arose. If you use the free version, that amount is zero.

Some jurisdictions do not allow certain exclusions or limitations. Where that is the case, the exclusions above apply only so far as the law permits, and nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

Indemnity

You agree to defend, indemnify and hold us harmless from any claim, damage, loss or expense, including reasonable legal fees, arising out of the content of your surveys, the way you operate your website, your use of SurveyX in breach of these terms, or your infringement of anyone else's rights.

Suspension and termination

You may stop using SurveyX at any time and cancel a renewal from your Freemius account. We may suspend or terminate a Pro licence if these terms are seriously or repeatedly breached, for example if a licence key is redistributed or the licensing system is tampered with. If we do, we will tell you why.

Ending a licence does not touch your website: your surveys and responses stay in your database, and the free version of SurveyX Builder remains available to you. On termination your right to use the Pro files ends and you should remove them from your sites. The sections on ownership, acceptable use, warranties, liability and indemnity survive termination.

Changes to these terms

We may update these terms as the product and the law develop. The date at the top of this page always shows the current version, and significant changes will be announced on this website before they take effect. Continuing to use SurveyX after that means you accept the updated terms.

Governing law and disputes

Your purchase is made with Freemius, not with us. Freemius Inc. is our authorised reseller and merchant of record, and the Freemius End User License Agreement for SurveyX Builder is the agreement that covers that transaction, including its own choice of law and its own dispute process. For anything to do with the purchase, that agreement governs and nothing here overrides it.

These terms cover your use of this website and of the software itself. If you are a consumer, the mandatory law of the country you live in applies to you whatever these terms say, and you may bring proceedings before the courts there.

Before starting any formal dispute, please email [email protected] and give us a fair chance to put things right. Almost everything is quicker to resolve that way.

General

If any provision of these terms is found unenforceable, the rest stays in force. If we do not enforce a right straight away, that is not a waiver of it. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or sale of the business. Together with the Privacy, Refund and Support policies, these terms are the entire agreement between us about SurveyX.
